Terms of Service

1. Acceptance of Terms

By accessing or using the Loftfolio platform (“the Service”), operated by Creative Current LLC(“Company,” “we,” “us”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Loftfolio provides a multi-tenant platform for real estate agencies to create branded websites, manage property listings, process rental applications, and coordinate team workflows. The Service includes a public-facing agency website hosted on a subdomain, a dashboard for managing operations, and related features as described on our website.

3. Account Registration

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activity under your account

4. Account Types and Plans

We offer several plans, including a free tier, with varying features and limits. The features, limits, and prices of each plan are set out on our pricing page. We reserve the right to modify plan features and pricing with 30 days' notice to affected users.

5. Free Plan and Trial

Creating an account is free and does not require a credit card. New accounts begin with a 14-day trial of our paid features.

When the trial ends, you are not charged and your account is not locked. It moves to our permanent Free plan, and you keep your agency website and your data, subject to the Free plan's limits described on the pricing page. You can stay on the Free plan for as long as you like.

We only ask for payment details if you choose to subscribe to a paid plan, and those details are entered on Stripe's hosted checkout rather than on our platform.

6. Payment Terms

• Subscription fees are billed monthly in advance
• Payment is processed securely through Stripe
• All fees are non-refundable except as expressly stated
• We may change fees with 30 days' notice
• Failure to pay may result in your account reverting to the Free plan

7. User Responsibilities

You are solely responsible for:

• All content published on your agency website including listings, descriptions, and images
• Compliance with applicable laws in your jurisdiction regarding rental listings, tenant screening, and data protection
• Obtaining necessary consents from tenants and applicants whose data you collect
• Accurate representation of properties and their availability
• Proper handling of applicant data in accordance with applicable privacy laws

8. Prohibited Conduct

You may not:

• Use the Service for any illegal purpose or in violation of any laws
• Upload or transmit viruses, malware, or any malicious code
• Attempt to access another user's account without authorization
• Use the Service to send unsolicited communications (spam)
• Reverse engineer, decompile, or disassemble the platform
• Engage in discriminatory housing practices prohibited by the Fair Housing Act or equivalent laws in your jurisdiction

9. Intellectual Property

The Loftfolio platform, including its code, design, logos, and branding, is owned by Creative Current LLC. You retain ownership of the content you publish on your agency website (listings, images, descriptions). You grant us a license to host and display this content as part of providing the Service.

10. Data Privacy

Your use of the Service is also governed by our Privacy Policy and GDPR Compliance page. By using the Service, you consent to the collection and use of your data as described in those policies.

11. Third-Party Services

The Service integrates with third-party services (Supabase, Vercel, Stripe, Resend, and DeepSeek for the optional AI copy feature). We are not responsible for the acts or omissions of these third parties. Their use is governed by their respective terms of service.

12. Limitation of Liability

To the maximum extent permitted by law, Loftfolio and Creative Current LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

14. Cancellation and Termination

You may cancel your subscription at any time from your billing settings. Upon cancellation:

• Your paid plan stays active until the end of the current billing period
• After that period ends, your account reverts to the Free plan and is subject to the Free plan's limits
• Your agency website stays online and your data is retained
• Nothing is deleted automatically — permanent deletion happens only when you ask us for it

We reserve the right to terminate or suspend accounts that violate these terms. We will provide notice where possible.

15. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email to account holders. Continued use of the Service after changes constitutes acceptance of the updated terms.

16. Governing Law

These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New Mexico, United States.
